USA Extends STEM OPT to 3 years. What’s New in the OPT Policy?

1. Extended OPT Duration for STEM Students:

If you're studying in a STEM field, the new policy allows up to three years of OPT. This extension gives you more time to build valuable work experience in the US, helping to enhance your career prospects.

2. Flexibility for Distance Learning:

The updated guidelines now permit you to count up to three online credits per term towards your full course of study. This flexibility ensures you can adapt your learning approach without violating F1 visa terms.

3. Eligibility for OPT After an Associate’s Degree:

Previously, OPT was typically reserved for students completing a bachelor’s, master’s, or doctoral degree. Now, students finishing an associate’s degree can also apply for post-completion OPT, expanding opportunities for those in shorter programs.

4. Easier Transfer Between Schools:

Transferring between SEVP-certified schools is now more straightforward. Whether you're switching study streams or moving to a higher level of education, the process has been clarified, making it easier for students to navigate.

Key Points to Remember

  • 60-Day Grace Period: After completing your OPT, you have 60 days to change your education level, transfer to another SEVP-certified school, or apply for a different visa status. During this period, employers can sponsor your H-1B visa, but remember, the H-1B visa process includes a lottery.

  • Applying for OPT Extensions: You can apply for a STEM OPT extension up to 90 days before your current employment authorization expires.

  • Study Abroad Programs: If participating in a study abroad program lasting less than five months, you can stay active in SEVIS. For longer programs, a new Form I-20 is required.

What You Need for a STEM OPT Extension

To qualify for the 24-month STEM OPT extension, ensure you have:

  • A valid period of post-completion OPT.

  • A degree in a STEM field from an accredited school recognized by the US Department of Education.

  • Employment with an employer enrolled in E-Verify.

If you’ve previously obtained a STEM degree and are currently on OPT with a non-STEM degree, you might still be eligible for an extension based on the earlier STEM degree. Additionally, if you pursue another STEM degree at a higher level, you can apply for an additional 24-month OPT extension.

Employer Responsibilities:

Employers offering training to STEM OPT students must:

  • Be enrolled in E-Verify.

  • Report significant changes to the student’s employment status.

  • Provide a formal training program that aligns with the student’s academic learning.

  • Ensure the OPT opportunity is comparable to those offered to US workers in terms of duties, hours, and compensation.

Unemployment During OPT:

You are allowed up to 90 days of unemployment during your initial OPT period. For the 24-month STEM extension, an additional 60 days is permitted, making it a total of 150 days.
